Kerry Moynihan concentrates her practice on bankruptcy and insolvency matters, business litigation, and complex receivership and bankruptcy litigation in the state and federal courts. Ms. Moynihan has represented corporate debtors, trustees, secured and unsecured creditors, administrative claimants, lessors, franchisors, shareholders and others in chapter 7, 13 and 11 bankruptcy cases.
Ms. Moynihan has prosecuted and defended numerous avoidance actions, claim disputes, contested plan confirmations, and bankruptcy appeals. She has also handled objections to discharge and dischargeability litigation on behalf of unsecured lenders and judgment creditors. Ms. Moynihan has represented creditors and receivers in litigation involving complex fraudulent transfers, judicial foreclosure, guaranty enforcement, lien priority disputes, alter ego liability, fraud, and breach of contract. She also has experience with court-approved mediation programs and out of court settlement negotiations.
Ms. Moynihan received her undergraduate degree from Boston University, magna cum laude, in 2003, and obtained her Juris Doctor from Boston University School of Law in 2006. She has been selected to Southern California Super Lawyers Rising Stars List each year since 2013, including Up-and-Coming 25 in Orange County (2019, 2020) and Up-and Coming 50 Women in Southern California (2019, 2021). She is on the Board of Directors of the Orange County Bankruptcy Forum, is actively involved with the California Bankruptcy Forum, and is a member of the Orange County Women Lawyers Association.
